SUPERINTENDENT OF SCHOOLS – CONTRACT, TERM

The Board of Directors shall offer a contract of employment to the Superintendent of Schools for a term of up to three years. The term shall be specified in the written employment contract.  The Board may issue a temporary and nonrenewable contract in accordance with law.

The first three consecutive years of a contract issued to a newly employed superintendent is considered a probationary period.  The probationary period may be extended for an additional year upon the consent of the superintendent.  The Board reserves the right not to renew or extend a contract with the Superintendent for any reason. The Board reserves the right to dismiss the Superintendent during a contract term with just cause in accordance with law.  In the event of termination of a probationary or nonprobationary contract, the Board will afford the superintendent appropriate due process, as required by law.  The superintendent and Board may mutually agree to terminate the superintendent’s contract at any time.   If the Superintendent wishes to resign from a contract, the Superintendent must comply with applicable law and Board policies and regulations.

SUPERINTENDENT OF SCHOOLS – QUALIFICATIONS, RECRUITMENT, APPOINTMENT

The Board of Directors shall appoint a Superintendent of Schools to serve as the executive officer of the Board of Directors and as the leader of the administrative team.  In selecting a Superintendent of Schools, the Board shall follow its policies on equal employment opportunities and affirmative action.  The Board may utilize consultants to assist it in recruiting and selecting a Superintendent.

The Superintendent shall meet the licensure requirements as designated by the Iowa Department of Education and the Iowa Board of Educational Examiners, shall have demonstrated exemplary leadership abilities, and shall exhibit the knowledge and ability to accomplish the duties of the job description.  The Board of Directors shall select a Superintendent of Schools based upon such additional qualifications and qualities as may be determined from time to time by the Board as being necessary to accomplish the District's educational philosophy, goals and objectives.

303.2 Superintendent of Schools - Functions and Duties

SUPERINTENDENT OF SCHOOLS - FUNCTIONS, DUTIES

The Superintendent of Schools shall be the executive officer of the Board of Directors and shall be directly responsible for the execution of the Board's policies and for the enforcement of all provisions of law relating to the operation of the schools.  The Board delegates to the Superintendent the authority and responsibility to administer the District and to implement decisions made by the Board.  The Superintendent shall have the power to make rules and render decisions not in conflict with law or with Board policies or actions.

The Superintendent shall be authorized to organize the administration in such manner as to facilitate the most efficient and effective operation of the District.  The Superintendent shall have the discretion to delegate to other school personnel the exercise of any authority and the discharge of any responsibility imposed upon the Superintendent by law or by Board policy or action.  The delegation of power or duty, however, shall not relieve the Superintendent of accountability for the results of such delegation.

The responsibilities of the Superintendent shall be enumerated more specifically in a job description adopted by the Board which, however, shall not act to limit the broad authority and/or the responsibilities of the office of Superintendent.

303.4 Superintendent of Schools – Salary and Benefits

SUPERINTENDENT OF SCHOOLS - SALARY AND BENEFITS

The Board retains discretion to set the salary of the Superintendent of Schools on an annual basis at the beginning of each contract year.  The salary of the initial year of a multi-year contract shall be specified in the contract.  The Board may agree not to lower the annual compensation in subsequent years if so specified in the contract.

The Superintendent shall have such benefits as specified in Board policies and such additional or greater benefits as may be specified in the contract of employment.

303.5 Superintendent of Schools – Evaluation

SUPERINTENDENT OF SCHOOLS - EVALUATION

The Board of Directors shall be responsible for the formal evaluation of the Superintendent.  The primary purpose of formal evaluation of the Superintendent is to improve and enhance the performance of the Superintendent and to communicate to the Superintendent the Board’s perception of his/her performance and to provide written documentation of the Superintendent’s level of performance to provide a basis for contract decisions, including salary considerations and for contract termination, if necessary.  The Board may utilize in its evaluation relevant information from other persons as it so desires.  The Board and Superintendent shall agree on a method of evaluation and the evaluation form shall be adopted by the Board.

The Board will formally evaluate the Superintendent at least two times each contract year during the first two years of employment as Superintendent of the District.  Thereafter, the Board will formally evaluate the Superintendent at least once each year.
