903.1 Community Use of School Facilities

COMMUNITY USE OF SCHOOL FACILITIES

The Board promotes the concept of school facilities serving as a center for community activities.  Therefore, groups or organizations in the community will be allowed to use school facilities when the following conditions are met:

1.     The use does not interfere with or interrupt the District's educational and activity programs.

2.     The use is consistent with state law and conforms to and complies with District policies, rules and regulations.

3.     The group or organization is responsible and will exercise care in the use of the facilities.

4.     The activity is constantly supervised by an adequate number of adult sponsors.

5.     Adult sponsors ensure compliance with Governor Reynolds’s current or future orders allowing facilities to open including: supervision of required capacity limits, supervision of required group size limits, supervision of required social distancing practices, and sanitization and hygiene requirements.

6.     No alcoholic beverages, controlled substances, substance paraphernalia, look-alike substances, tobacco or tobacco products are available or used on school grounds. 

7.     Animals are not brought onto District property without prior District approval.

8.     If a key/FOB is checked out by an adult sponsor, the sponsor shall not lend the key to any other person and shall be the first person to arrive and the last person to depart.  The key must be returned on the next business day.

9.     The activity is confined to the area designated, and no school equipment or supplies are used except as approved in advance.

10.  No District property shall be moved or rearranged without District approval.  All property of the organization must be immediately removed.  All trash shall be properly disposed of in accordance with District directions.

11.  A written Application and Agreement for use of Decorah Community School District Facilities and Equipment is executed and approval is received in advance through the Superintendent or its designee.

12.  Fees are paid in advance, if requested.

13.  The group or organization shall be responsible for paying for any damage or destruction to the school property.

14.  The group or organization shall indemnify and hold the District, its officers, employees, and agents harmless from any claims or charges arising from the actions or inactions of the group or organization.

15.  A liability insurance certificate is provided in advance, if requested.

16.  While the District may sponsor use by education-related organizations of the District's ICN room, the organization's mission must be consistent with the District's mission.  Organizations authorized to use the ICN room must ensure their use of the ICN room is consistent with their mission, that the ICN will not be used for profit-making ventures, and that they will not resell time on the ICN.  The organizations must follow the state scheduling requirements, as well as schedule the room through the District.

17.  It shall be the responsibility of the organization using the ICN room to originate, receive and broadcast programming in compliance with the law regarding authorized use of and content of the programming on the ICN.  The District assumes no responsibility or liability for organizations using the ICN room in violation of the law, District policies and rules and regulations.

A written application and agreement must be executed by the group or organization and approved by the Superintendent.  If the Superintendent denies the request, the group or organization may appeal by using the Complaint Procedure, starting at the Superintendent's level.  The Board reserves the right to disallow a use approved by the Superintendent and may withdraw approval.

Fees shall be charged for use of District facilities.  The fee schedule shall be established by the Board.

Group 1:  School-affiliated groups (such as Booster Clubs, Parent-Teacher Associations, professional associations), recognized community recreational programs sponsored by not-for-profit organizations, not-for-profit youth groups (such as Boy Scouts, Girl Scouts, Junior Achievement), and adult education groups.

 

                         Group 1 entities shall not be charged a rental fee.  They may be charged custodial services, food service fees, and for operation of the sound system.

 

 

Group 2:  Not-for-profit civic and community groups, churches, and families.

 

                         Group 2 entities shall not be charged a rental fee.  They may be charged custodial services, food service fees, and for operation of the sound system.

 

 

Group 3:  For-profit groups.

1.      Availability of the facilities and/or equipment is contingent upon the activity in no way interfering with the District's educational and activity program. I/We understand that the District reserves the right without penalty (but with refund of the charges) to cancel any agreement to allow my/our use of the facilities and/or equipment.

2.      The use of the facilities and/or equipment will not conflict with any laws or the policies, rules, or regulations of the District.

3.      I/We will exercise care in the use of the facilities and/or equipment and agree to compensate the District for any damage done to the facilities or property of the District. (The individual representative(s) agrees to reimburse the District in the event the organization fails to make reimbursement.)

4.      The activity will be constantly supervised by an adequate number of adult sponsors.

5.      No alcoholic beverages, controlled substances, substance paraphernalia, or look-alike substances will be made available, used or consumed on the District grounds.

6.      No smoking or use of tobacco products will be allowed on the District grounds.

7.      Animals shall not be brought onto District property without permission of the District.

8.      If a key is checked out, the person to whom the District checks out the key will be the first to arrive and the last to leave and will insure that all lights and equipment are turned off and the facility locked.  The key will not be loaned to anyone and will be returned the next District business day.

9.      The activity will be confined to the area approved and no school equipment or supplies will be used except as approved in advance.

10.    The activity is not for a commercial profit-making venture or for personal financial gain.

11.    If the facility being used is a gymnasium, all participants will wear gym shoes.

12.    No District property shall be altered, moved or rearranged without District approval.  All property of the organization must be immediately removed.  All trash shall be properly disposed of in accordance with District directions.

13.    I/We agree to provide an insurance certificate naming the District as an additional insured with the appropriate limits, if requested, in advance of the activity.

14.    The District retains the right to access the facilities and to remove persons from District property.

15.    The representative and the organization agree to indemnify, save and hold harmless the District, its agents, employees, and officials from any and all claims or damages, including attorney fees and expenses, that may arise by reason of the organization’s use of the facilities and/or equipment or arising from any activity thereon by the organization, its officers, agents or employees.

903.1R1 ICN Room Use Regulation

ICN ROOM USE REGULATION

 

The ICN is a statewide telecommunications network designed primarily to enhance learning opportunities for students, employees and board members.  The District recognizes that it is not the only authorized user of the ICN and other users will frequently be using the District's ICN facilities.  Sponsored and authorized users of the ICN must comply with state and federal law in using the ICN.

The media director is responsible for coordinating ICN classroom use.  Requests for use of the ICN classroom by employees for the educational program shall be filed with the media director.

It shall be the responsibility of the entity using the ICN classroom to comply with the requirements of the law and District policy and its supporting administrative regulations.

1.      The ICN is a limited access network and sponsored or authorized users cannot use the system for profit making ventures.

2.      The ability to use the network is a privilege conferred by law to any person who qualifies as an authorized user.

3.      The use must be consistent with the mission of the sponsored or authorized users.

4.      Users cannot resell time on the ICN.

5.      Sponsored and authorized users are responsible for compliance with the Americans With Disabilities Act and Iowa Civil Rights Act.  Sponsored and authorized users are responsible for making the necessary accommodations and are responsible for obtaining and paying for needed interpreters or interpretive equipment.  The cost of reasonable accommodation is assumed by the requesting authorized user.

6.      Sponsored and authorized users are required to stay within the ICN classroom and use the most direct route to the ICN classroom.  Other District facilities, sites, areas in the school district building or equipment are off limits to the authorized users, unless permission has been granted.

7.      The ICN will be available Monday through Friday, 7:00 a.m. to 10:30 p.m. and Saturday, 8:00 a.m. to 4:00 p.m.

8.      The sponsored or authorized user is responsible for all site and site usage charges.

9.      Food and drink are not permitted in the ICN room.

10.    First time use of the ICN will require prior training and should be organized through the District ICN scheduler.

11.    Use or transmission of copyrighted material, without prior approval of the copyright holder, is strictly prohibited.  Appropriate use of the copyrighted material is the responsibility of the sponsored or authorized user, not the District.

12.    Use of the network does not imply endorsement of, or agreement with, the purpose(s) or the expression of any person or entity by the District or its employees or staff.

13.    The District reserves the right to amend these rules as necessary to reflect the ICN's usage and changes at the state of federal level.

14.    The District reserves the right to charge all costs, including attorney's fees, that may arise to the authorized user for the sponsored or authorized user's failure to comply with the law, board policy and administrative regulations.

The District shall not allow persons to use District property to operate a political phone bank for any of the following purposes:

 

  1. To poll voters on their preferences for candidates or ballot measures at an election.
  2. To solicit funds for a political candidate or organization.
  3. To urge support or defeat for a candidate or ballot measure to voters.

903.4 Community Use of School Buses

COMMUNITY USE OF SCHOOL BUSES

 

 

Conditions.  The Board of Directors desires to encourage support of its activities and programs and to cooperate with recognized community organizations in making available District buses to such organizations for specified purposes, but also recognizes its obligations to provide transportation to students on a cost-efficient basis.  Therefore, the Board of Directors adopts the following conditions for community use of school buses:

            a.      The use shall in no way interfere with the student educational and activity program of the District.

            b.      The use must be consistent with state law and conforms to and complies with the rules, policies and regulations of the District.

            c.      The activity sponsored for which transportation is necessary must be lawful and must be within the State of Iowa.

            d.      The group or organization must be responsible, and the activity and bus must be supervised by an adequate number of adult sponsors.

            e.      No alcoholic beverages, controlled substances, substance paraphernalia, or look-alike substance may be available, used or consumed on the bus.

            f.       No smoking or tobacco products will be allowed in the bus.

            g.      The group or organization must be located within the District boundaries, must be a tax-supported or tax-exempt organization or an organization created to support District programs (e.g. PTA or booster clubs), and must be providing an activity in support of District students, senior citizens or the disabled.

            h.      A written Application and Agreement for use of a Decorah Community School District Bus must be made in advance through the Superintendent or its designee.

            i.       A District bus driver must operate the bus.

            j.       The charges must be paid in advance, if requested.

            k.      An insurance certificate naming the District as an additional insured with the appropriate limits shall be provided in advance of the activity, if requested.

            l.       The group or organization shall be responsible for paying for any damage or destruction to the school bus.

            m.     The group or organization shall indemnify and hold the District, its officers, employees, and agents harmless from any claims or charges arising from the actions or inactions of the group or organization.

Charges.  The group or organization shall be charged an amount sufficient to reimburse all costs of furnishing the bus and the driver (including the driver's salary and fringe benefits).
